Prosecution Reveals Horgan and Carolyn's Relationship in Opening Statement

Presumed Innocent

Nico Delia Guardia’s opening statement publicly disclosed that Carolyn Polhemus had been involved with Raymond Horgan as well as Rusty Sabich. By presenting the relationship as a source of Rusty’s jealousy, Nico introduced a previously unpublicized connection into the murder trial and gave the prosecution’s account a politically sensitive complication.

The Prosecution’s Account

Nico told the jury that Rusty and Carolyn had maintained a personal relationship for many months, beginning at least seven or eight months before the murder. He cited Rusty’s presence at Carolyn’s apartment and the phone calls between them, then characterized the relationship as intimate. He next portrayed Rusty as unhappy and intensely jealous, arguing that Carolyn’s involvement with someone else had infuriated him.

Nico identified that other person as Raymond Horgan, the prosecuting attorney. The disclosure went beyond describing Rusty and Carolyn’s relationship: it suggested that Rusty’s alleged jealousy had a specific rival as its cause. In the account narrated by Rusty, this connection had never before become public. Nico had apparently kept it out of view to protect his new alliance with Horgan, yet disclosed it in court all the same.

The Judge’s Rebuke

The statement crossed from a recital of the prosecution’s expected evidence into argument about Rusty’s emotional state and motive. Larren Lyttle, who had already warned Nico against that approach, turned on the bench and glared at him. Although Lyttle signaled that Sandy Stern could object, Stern remained quiet; he knew Nico was making claims the prosecution might not be able to prove.

After Nico named Horgan, the courtroom stirred, and Lyttle lost his composure. He warned Nico again that an opening statement was not to become a closing argument, ordered him to confine himself to a sterile recitation of facts, and threatened to end the opening if he continued. Nico faced the bench, appeared surprised, and agreed to comply.

Consequences in the Trial

The disclosure altered what the courtroom audience knew about the relationships surrounding the case. Horgan was not merely the current prosecuting attorney: Nico’s account placed him in a personal relationship with Carolyn and framed that relationship as relevant to the prosecution’s theory of Rusty’s jealousy. The revelation also exposed a tension within the prosecution’s political alignment, since the information Nico had apparently withheld to protect Horgan became part of his own public presentation.

The judge’s interruption checked the manner of the disclosure but did not undo it. The relationship had entered the public record of the trial, while Lyttle’s warning underscored the distinction between presenting evidence and asking the jury to accept an unproved interpretation of it.
